Public meeting for proposed cannabis regulations

The Town of Pelham has initiated amendments to the Official Plan (File no. OP-AM-01-19) and Zoning By-law (File no. AM-07-19) under Sections 22 and 34 of the Planning Act, R.S.O. 1990, to include policies and regulations with respect to cannabis production within the Town. Amendments to the Fence By-law, introduction of a Fortification By-law and a Cannabis Nuisance By-law under the Municipal Act, 2001, R.S.O.2001, c.25 are also proposed. All documents will work together to better manage and control cannabis production facilities in the Town and are intended to address adverse impacts of cannabis production in the Town.
The Draft Official Plan Amendment proposes to:
- Support legal cannabis production within Good General Agricultural, Specialty Agricultural, and Industrial designations;
- Require submission of odour and light impact studies for such operations;
- Require a Zoning By-law Amendment for certain greenhouse operations and all outdoor cannabis production.
The Draft Zoning By-law Amendment proposes to:
- Permit legal cannabis production, in a structure, in Agricultural (A) and Light Industrial (M1) zones;
- Set regulations for minimum setbacks from any sensitive land use receptor of 150 metres or as recommended by odour impact analysis, whichever is greater.

IMPORTANT INFORMATION
If a person or public body does not make oral submissions at a public meeting or make a written submission to the Town of Pelham on the Planning Act matters before the proposed Official Plan and Zoning By-law amendments are adopted, the person or public body is not entitled to appeal the decision to the Local Planning Appeal Tribunal. Further,
the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there is reasonable grounds to do so.
If you wish to be notified of the decision regarding the proposed Zoning By-law and Official Plan amendments, you must make a written request to the Clerk of the Town of Pelham and such request must include the name and address to which such notice should be sent.
